Rules

Art. 1. Purpose

These rules set out the general conditions in force for the competition entitled "Win a dyson" (hereinafter the "Competition") organised by BWC S.R.L., whose registered office is located at 120 Avenue des Croix de Guerre, 1120 Brussels, registered with the Banque-Carrefour des Entreprises under number BE0842 448 364 (hereinafter the "Organiser").

The participants declare that they are aware of the content of these regulations.

By participating in the competition, participants acknowledge that they accept the conditions set out in these rules.

The rules are distributed in our participating gaming houses upon request.

Participation in the competition implies acceptance of these rules.

Art. 2. Conditions of participation in the Competition and exclusions

The Competition is open to all persons who are at least 21 years old, excluding:

The persons included in the EPIS list of players excluded from gaming houses and sports betting games in Belgium are excluded from the Competition.

BWC S.R.L. reserves the right to exclude a person from the Competition in the event of non-compliance with one or more of the conditions of these rules or in the event of fraud, abuse, deceit or participation in bad faith.

Art. 3. Competition procedure and awarding of the Prize

3.1 Competition procedure

The Competition takes place on 26/02/24 on  10/03/24 to 11.55 pm included.
In order to take part in the Competition, participants must be in possession of a valid code obtained when entering the participating Golden Palace gaming houses. They are then entitled to transcribe it into the appropriate tab on the www.winandmore.be website.

Entrants must answer the Competition questions correctly.

In the event of a tie, a subsidiary question will be used to decide: the participant whose answer comes closest to the correct answer will be declared the winner.

In the event of a further tie, the first participant to return the questionnaire will win the prize.

The number of tickets per person is limited to 1 ticket per day and per participating gaming house.

Tickets are personal and cannot be transferred or sold. Any code entered on the site that does not correspond to the identification details filled in by the player will result in the participation being declared null and void.

Only complete entries received before the end of the competition will be taken into consideration.

3.2 Awarding of the prize

The prizes consist of a Dyson.

The Prize is indivisible and must be accepted as such.

Under no circumstances may the prize be exchanged for other products or cash. The prize is personal and cannot be transferred.

The winners will be notified by e-mail and their first and last names will be posted on the Golden Palace Group's social networks page.

In the absence of a response within 2 working days, they will be contacted on the mobile phone number communicated via the entry form.

In the absence of a response to this call within 2 working days, the winners acknowledge that they will be disqualified and will lose their right to the prize.

Art. 4. Identification

The identity of the participant is defined on the basis of the data provided by the participant:

BWC S.R.L. cannot be held responsible if the identification of a participant is impossible due to erroneous or incomplete data communicated by the participant.

The use of false data leads to the exclusion of the participant.

Participants agree to accept the publication of their names, without however claiming any compensation.

By entering this competition, participants agree to be kept informed of the results of this competition via a newsletter sent by one of the Golden Palace companies.

The winners of the competition agree to take part in various promotional operations without claiming any compensation for a period of 6 months, including interviews, photo and video shoots and quotes of their name to be published on social networks, in particular in the BWC S.R.L.'s Newsletter, as well as in the written and audiovisual press and on the Internet.

Art. 5. Liability

Neither BWC S.R.L., nor its staff, nor any of the partners involved in the Competition may be held liable for any direct, indirect, material, immaterial or corporal damages that may result from the use of the prize. In this case, the winner must contact the manufacturer of the prize.

In particular, and not exhaustively, BWC S.R.L. cannot be held liable in any way for the following cases:

In the case of Competitions via the Internet: any participation in the Competition implies acceptance of the specific characteristics of the Internet, in particular with regard to the technical capacities and the response time during consultation, questioning, transfer of information, the risks of interruption and, more specifically, the risks inherent in any connection to/transmission via the Internet, the lack of protection of certain data against possible theft and the risks of contamination by possible viruses circulating on the Internet.

No complaint may be lodged with BWC S.R.L. regarding these restrictions.

Art. 6. Image rights

Each Participant authorises BWC S.R.L., and the partner companies of the Competition in which he/she has participated, to reproduce and communicate to the public his/her name and surname, voice and/or image by any means and processes and on any media, in particular on the www.goldenpalace.be website, for a period of two (2) years from the date of the start of the Competition and for the entire world, without this use giving rise to any compensation whatsoever.

Art. 7. Personal data

7.1. BWC S.R.L. will process the personal data submitted in connection with the Competition and referred to in Article 4 of these Rules, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

7.2. Data Processing Officer- Participants in the game are informed that BWC S.R.L., as the company organising the Competition, is responsible for processing the personal data referred to in Article 4 of these rules, and therefore carries out automated processing of such data, particularly when participants log on and register on the www.windandmore.be website. And on the website www.goldenpalace.be.

7.3. Data collection and purpose - The participants authorise BWC S.R.L., in a free and informed manner, to collect their personal data during their participation in the Game.

The personal data collected and processed by BWC S.R.L. is used for the following purposes:

Subject to their express consent, the information collected on the Participants may be used by BWC S.R.L. for marketing purposes, namely to inform them regularly of offers of new products and games available in the Golden Palace gaming houses and on the website www.goldenpalace.be, of the organisation of new competitions, as well as of the activities and services offered by BWC S.R.L.

7.4. Participants have a right of access and a right of rectification relating to this data, and where appropriate a right to oppose their use for direct marketing purposes. To this end, the Participant need only send a letter to the following postal address: 120 Avenue des Croix de Guerre - 1120 Brussels, enclosing a copy of his or her identity card.

7.5. BWC S.R.L. will take all necessary precautions to keep the data communicated confidential.

By confirming the sending of his or her personal data, the Participant acknowledges that the sending of such data is never without risk.

7.6. For more information, the privacy policy is available at https://www.goldenpalace.be/conditions-d-utilisation which tells Participants how they can adjust their privacy settings.

Art. 8. Proof

8.1. It is agreed that BWC S.R.L. may rely, in particular for the purpose of proving any act, fact or omission, on programs, data, files, records, operations and other elements (such as monitoring reports or other reports) of a nature or in computer or electronic formats or media, established, received or stored directly or indirectly by BWC S.R.L., including in its information systems.

8.2. The elements considered constitute evidence and, if they are produced as evidence by BWC S.R.L. in any litigation or other proceedings, they shall be admissible, valid and enforceable in the same manner, under the same conditions and with the same probative force as any document drawn up, received or kept in writing.

Art. 9. Complaints

9.1 In case of participation in the Competition via a smartphone, the brand behind the operating system of the smartphone (Apple, Google, etc.) or the brand of the smartphone must not be considered as a sponsor or involved in any way in the Competition.

9.2 Any complaint regarding this Competition, its running and/or the prize attached thereto must be sent in writing, at the latest within 10 calendar days after the end of the Competition, to the following address: Avenue des Croix de Guerre 120, in 1120 Brussels

Complaints may not be dealt with orally or by telephone.

Complaints made outside of the prescribed period, not made in writing or whose author cannot be identified by name will not be dealt with.

Art. 10. Acceptance of the Rules

10.1. Any participation implies unconditional, full and complete acceptance of the mechanics of the Competition, the Rules and any amendments thereto and no dispute relating thereto will be taken into consideration.

10.2. Any person who contravenes one or more of the Articles of the Rules will be deprived of his or her right to participate in the Competition and, if applicable, to obtain the Prize attached thereto.

10.3. The Rules and any amendments thereto are available at any time on www.winandmore.be.

Art. 11. Changes to the Competition

11.1 BWC S.R.L. reserves the right, in agreement with the partner companies, to change the organisation, suspend, shorten, extend, postpone, cancel or terminate the Competition at any time, without prior notice, without indication of reasons and without compensation to the Participants or third parties. An announcement will be posted on the www.winandmore.be website.

11.2 In the event that BWC S.R.L. or one of its partners is forced to prematurely end, modify or terminate the Competition as a result of the inappropriate behaviour of one of the Participants, BWC S.R.L. reserves the right to claim compensation for the damage suffered as a result.

11.3 BWC S.R.L. may at any time exclude a person from participation in the Competition as a result of a breach of one of the conditions of participation or in the event of abuse, deception or perfidious participation in the Competition. Any attempt at fraud on the part of a person participating in the Competition may result in the invalidity of his or her entry. Furthermore, BWC S.R.L. may exclude any Participant who has provided false data.

Art. 12. Governing Law and Disputes

12.1 Governing law

BWC S.R.L. shall have sole authority to settle, in accordance with Belgian law, any dispute relating to the interpretation and/or application of the Rules and any amendments thereto.

12.2 Disputes

Participants shall, in the event of a discussion concerning the application or interpretation of the Rules, first seek an amicable solution with BWC S.R.L. before initiating legal proceedings.

In the event of persistent disagreement concerning the application or interpretation of the Rules and any amendments thereto or in the absence of an amicable agreement, the dispute shall fall within the exclusive jurisdiction of the courts of the district of Brussels, in the French language.
